The contract for driving tuition is solely between yourself and your instructor and a declaration must be signed by the student before any lessons commence. These Terms and Conditions apply to that contract. All driving lessons and courses are operated by EV-Lution Automatic Driving School.
EV-Lution Automatic Driving School reserves the right to decline any booking at their discretion.
Driving is potentially hazardous. You should be aware of this. We will take all reasonable precautions to ensure your safety whilst you are learning with us, however you should also do your best to prevent injury or accident to yourself or others. Do as your instructor tells you at all times while under his instruction. If you are unsure about anything get it clarified before carrying on with the lesson.
In the interests of comfort and safety students are advised to wear suitable attire which does not restrict movement. Students must also take note of any medication they are taking that may affect their ability to drive safely and must advise their instructor accordingly before taking any lesson booked. Students are required to attend lessons in a fit and proper manner for driving safely and with due regard for other road users.
Your Instructor is bound by a professional Code of Conduct in accordance with the Driving & Vehicle Standards Agency (DVSA), which ensures that he will be courteous, polite, tidy and punctual. He will behave in a correct, professional and ethical manner at all times.
The instructor’s car will be well maintained, clean and tidy at all times. The car is fitted with dual controls and fully insured for driving tuition and for use in driving tests. The car is deemed a no smoking area at all times under the Smoke Free Premises etc. (Wales) Regulations 2007.
Your Instructor is registered with the DVSA and is approved by them to give driving tuition and to display the Approved Driving Instructor (ADI) badge on his car. The instructor has also passed a CRB (DBS) check.
We strongly believes that in order to learn effectively all lessons must be structured to suit individual needs. It is for this reason that we offer a package of training to minimise costs whilst ensuring our students receive the highest quality tuition. Students are encouraged to purchase any additional material which we deem fit for purpose to help the student in passing both the theory and practical driving tests. Theory preparation is also available via our website. State of the art coaching formula linked with your home study ensures you will maximise your learning potential. All lessons systematically work through all training phases and your progress is recorded. Feedback at each stage will ensure that you are fully aware of your strengths and weaknesses.
Your Legal Requirements
You must hold a current, valid Driving Licence (Provisional or Full) which must be produced on or in advance of the first lesson. The instructor will carry out an eyesight check before commencement of the first lesson (ensuring you can read a car registration plate at a minimum of 20m or 20.5 metres for an old style number plate – approx. 5 car lengths). You will also be required to sign a registration form stating that you will read, understand, accept and agree to abide by these Terms and Conditions. Your attention is also drawn to your responsibilities under the Road Traffic Act concerning the use of alcohol and drugs. Please ensure you present yourself in a fit and proper state.
Individual lesson payments should be made direct to your instructor in cash at the commencement of each lesson or via bank transfer prior to the lesson. A non-refundable deposit equal to the cost of a one hour lesson at the current rate is required at the time of booking your first lesson. At this point a binding Terms and Conditions agreement is made between yourself and the instructor. Please note any deposit or subsequent training fees paid are non-refundable in the event that you decide to cancel the training once the booking has been accepted by your instructor. This does not in any way affect your statutory rights to be provided with the goods and services you have bought.
Please give your instructor as much notice as possible should you have to cancel or change a lesson. Should he be unable to re-book a lesson with another student, you will be charged for a cancelled lesson if less than 48 hours’ notice is given. Provided the instructor can easily obtain additional work for any individual lessons postponed no penalty will be incurred. If this is not possible the full training fee for the period in question may, at the total discretion of the instructor, be lost or charged.
Your instructor reserves the right to postpone lessons if he or she feels that the weather or road conditions are unsuitable or dangerous. The instructor cannot be held responsible for any costs incurred as a result of him having to postpone any lessons, for whatever reason.
Contacting Your Instructor & Bookings
Enquiries or bookings will be made directly with your instructor. Your instructor can be contacted directly using the mobile phone number he will issue to you. It is an offence for your instructor to use his mobile phone while on a lesson so a voicemail facility is available or send a text.
Students are advised to be punctual for their lesson appointments. You are asked to be prepared to start 10 minutes earlier or later than the time booked. The instructor will normally wait for a maximum of 10 minutes before the lesson is abandoned and the lesson fee forfeited or becomes due for payment.
Your instructor will make every effort to meet you at the start of the time booked for your lesson. However, this may not be possible due to unforeseen circumstances or traffic conditions. Your instructor will attempt to contact you by phone or text in order to notify you of any delay. Irrespective of the time of arrival of your instructor, the full lesson time will be given and made up at the end of the normal lesson time if possible or at a later date.
Driving tests are carried out by the DVSA. Three clear days’ notice of cancellation or postponement (not including weekends or public holidays) is required by the DVSA. Failure to provide the required notice will result in the loss of your test fee. Your instructor cannot be held responsible for any cancellations or postponements of tests by the DVSA. However, he will do all that is possible to arrange another test as quickly as possible.
Students must bring the following documents:
- provisional photocard driving licence
- theory test pass certificate (or confirmation) if you’re not exempt from taking the theory test
If you have an old-style paper licence instead of a photocard, you must also bring a valid passport.
Driving test bookings always take priority over lessons. Therefore, your lesson may be postponed to allow for someone else’s driving test and vice-versa. Changes to lesson bookings as a result of this will be notified immediately.
Your instructor reserves the right to withhold the use of a car for the test if, in their opinion, your driving is actually or potentially dangerous.
The driving instructor will endeavour to ensure that speed limits and other traffic regulations are complied with but the student should be aware that all driving penalty points and fines are the responsibility of the driver under UK law. If any driving offence occurs the student will be responsible.
We reserve the right to change prices, and details, of products and services (and any offers) posted online without notice. All products and services are subject to availability and we give no guarantee in this regard.
The provision of details, products and services on the website are not, and should not be construed as, an offer to sell or buy such products or services. Should you have any complaints or are not satisfied with any part of your training, all efforts must be made to resolve the matter directly with the instructor.
Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or mis-described goods or services provided. Our instructors have a statutory obligation to provide you with goods and services fit for the purpose for which they were bought and as described. If you have any doubts about your statutory rights please contact your local Trading Standards Department or Citizen’s Advice Bureau.
